RE: Publication of the LFIIEDB Implementing Regulations – Operationalizing the Mixed Investment Framework for Strategic Infrastructure
DECREE: Federal Official Gazette (“DOF”), May 8, 2026
EFFECTIVE: May 9, 2026
EXECUTIVE SUMMARY
On May 8, 2026, Mexico’s DOF published the Decree issuing the Implementing Regulations (the “Implementing Regulations”) of the Law for the Promotion of Investment in Strategic Infrastructure for Development with Well-Being (“LFIIEDB”). The Implementing Regulations entered into force on May 9, 2026.
Spanning 17 Titles and 320 Articles, the Implementing Regulations are the primary regulatory instrument for the LFIIEDB. In addition to operationalizing the Mixed Participation Schemes, project eligibility procedures and the structure of Special Purpose Vehicles (“SPV”), they expand the Law's definitional catalogue with key project-finance concepts (including Weighted Average Cost of Capital (“WACC”), Internal Rate of Return (“IRR”), FinancialEconomic Model, Risk Allocation Matrix, Contingent Liabilities and Payment Source) reducing discretion in the evaluation of projects before the Strategic Planning Council for Investment in Infrastructure (Consejo de Planeación Estratégica para la Inversión en Infraestructura) (the “Council”).
